Conditions

1.
Application
1.1.
These Conditions relate to the
ordering, delivery and supply of The Money Tree Book ("the book") from The Money Tree Venture (The Money Tree), to you. In this document, (unless the
contrary intention appears) references to we and us mean The Money Tree, its divisions, employees, agents and
representatives.
2.
Orders
2.1.
You may order the book from us and we
will supply the book to you by means of the Australian Postal Service or by
other appropriate courier or postal service.
2.2.
We will notify you if we are unable
to supply the book, either at all or by the date we specified. We will notify
you if there will be a delay in supply of the book to you and we will use our
reasonable endeavours to fill your order as soon as possible, unless you cancel
your order.
2.3.
To cancel an order either:
2.3.1.
Send
an e-mail "orders@mymoneytree.com.au" with the
subject line "Cancel Order #" and then the order number you were issued during
the ordering process (either via our call centre or on our website). This
e-mail must be received by us within 24 hours of the placement of your order.
Or;
2.3.2.
Phone
us within 24 hours quoting your order number you were issued during the
ordering process (either via our call centre or on our website).
3.
Delivery
3.1.
We will endeavour to deliver the book
ordered by you, and which we have agreed to supply, to your premises, or such
other address as agreed, as soon as is reasonably practicable. Delivery will be
at your expense.
4.
Return for Full Credit
4.1.
The book is returnable for a full refund
if all of the following are true:
4.1.1.
The
book did not meet your expectations as set by the description or explanation of
the book on our website and/or subsequent marketing and/or advertising.
a)
We would really appreciate a written
reason why you deemed our advertising or portrayal of the book to be
inaccurate.
4.1.2.
The
CD that is included free with the book is un-opened and the seal is intact and
has not been tampered with.
4.1.3.
It
is returned to us in its entirety and original "re-saleable" condition
(including CD seal intact) within 30 days of the transaction to purchase the
book took place.
4.2.
The cost of return freight will be at
our expense if all the sub-clauses to 4.1 are true.
4.3.
If there are any of the sub clauses
to section 4.1 in question you assume the risk of possibly incurring extra postage
and handling costs (of you sending the book to us and us returning the book to
you in the case of us using our discretion and not approving the refund).
5.
Return for Exchange
5.1.
If the book (or accompanying CD) has
been received and is faulty (misbound, misprinted, excessively
damaged, CD is un-readable etc.) simply return the entire product to us and we
will issue you with a replacement copy at our expense.
6.
Limitation of Liability
6.1.
Subject to your rights and remedies
available under the Trade Practices Act 1974 (Cth) or
equivalent state legislation, we shall not be liable to you for any loss, damage,
cost, expense or other claim, howsoever caused (including our negligence, or
the negligence of our employees, agents or representatives) which arise out of
or in connection with the book.
7.
Force Majeure
7.1.
If we are prevented from or delayed
in complying with any obligation under these Trading Terms and Conditions by
anything which is beyond our reasonable control, our obligation will be
suspended during the time that we are affected.
8.
General
8.1.
These Trading Terms and Conditions
and the applicable federal and state laws form the entire agreement between you
and us. You agree that none of the terms of purchase (or similar terms) which
you express or forward to us form part of the agreement or of any offer you may
make to us in relation to the purchase of the book.
8.2.
The Trading Terms and Conditions are governed
by the law in force in
South
Australia
and you agree to submit to the jurisdiction
of South Australian courts and tribunals.
